Your document retention policy can help you avoid and win lawsuits

Document retention is a key part of how your company does business

Document retention policy from a practical perspective is an integral part of how your company or how your organization does business. It can make sure that your employees are kept apprised of their status, kept apprised of their progress, and their standing within the organization good practices in personnel document retention can avoid litigation or if litigation cannot be avoided, can put you in the best possible position to defend against an employment litigation claim.

Your document retention policy- when the rubber meets the road-is really the most important key to prevailing in litigation and to preventing litigation.

Paperwork wins lawsuits
Most of the time, I have figured out when I get involved in litigation regardless of the strength of the law that’s on our side or regardless of the strength of the defenses that we might have, if I have a well-documented personnel file, if I have well-documented personnel disciplinary notices, I have a much better chance of prevailing on that case whether at trial or on summary judgment than I do if we have a great argument and there’s no paper there to back it up.

Anytime you’re in litigation, anytime you are trying to explain your actions, whether it be in litigation or just trying to avoid a lawsuit in the first place, the paper is a great help in telling your story. Basically, what litigation and avoiding litigation is telling your story in the most convincing way possible. A good document retention policy makes sure you’ve got paper there to document the way that you handled things, it’s all that much easier.
