Good Document Retention Saves You From Losing a Lawsuit

Document retention is time consuming and difficult, but well worth the effort

Document retention is becoming a very essential topic for any employer in today’s workplace. There have been a lot of developments in the last several years such as the Sarbanes-Oxley Act and some recent revisions of the Federal Rules of Civil Procedure, which really puts employers behind the eight ball whenever they’re faced with litigation or just in their day-to-day operations.

But document retention is something that employers and any company really have a hard time getting its hands around. Just because there is so much paper that you’re required to keep on a day to day basis and there’s so much paper that your business requires you to keep in order to keep the lights on that at times you can start to feel overwhelmed.

Document retention is a very daunting task and it can really eat up a lot of time that could be spent in other productive activities. However, it’s an essential activity that you need to stay on top of.

One thing that lawyers often tell their clients whenever they get a piece of litigation is, “This is the time when all of your – when all of the effort that you put in to keeping good records, this is the time when it pays off.”

Whenever you get that lawsuit and you can pull out a personnel file or you’re able to pull out a medical file or a complete investigation file that preserves and establishes your defenses to employment litigation, that is when you pat yourself on the back and you thank yourself for spending all the time that you spend on document retention and in keeping good files and in making sure that the information that you keep is necessary and accurate and basically covers you, in the event that something does go badly wrong.
